Start a business in the UK after graduation with Tier 1 (Graduate Entrepreneur) Visa

The Tier 1 Graduate Entrepreneur visa category allowed international graduates with a viable business plan to come to the UK to set up a business. This category is now closed to new applications but current holders of Tier 1 (Graduate Entrepreneur) Visa can still apply for extension and Indefinite Leave to Remain (settlement) under this category.

The UK government’s changes to some aspect of the Immigration Rules announced on 7 March 2019 came into force on 29 March 2019.

The end of the Tier 1 (Entrepreneur) Visa and Tier 1 (Graduate Entrepreneur) Visa categories were replaced by two new categories:

  • Start-Up Migrant Visa
  • Innovator Visa

More information will be shortly available on our website.

However, current holders of Tier 1 (Graduate Entrepreneur) Visa can still apply for a one-year extension under this category.

You previously could apply for a Tier 1 (Graduate Entrepreneur) Visa if you wished to establish one or more businesses in the United Kingdom after your graduation. You needed to be identified by Higher Education Institutions as being a person who had developed world class innovative ideas or entrepreneurial skills.

Your time on a Tier 1 (Graduate Entrepreneur) Visa will not count towards your Indefinite Leave to Remain (Settlement) application, however, you can switch into Start-Up Migrant Visa or Innovative Visa.

Tier 1 Graduate Entrepreneur Visa: Current Status

The Tier 1 Graduate Entrepreneur Visa was discontinued for new applicants in 2019. However, if you currently hold this visa, there are still pathways available to you:

Extension: You may be eligible to extend your Tier 1 Graduate Entrepreneur Visa. Your endorsing body will determine if you meet their ongoing criteria for sponsorship.

Settlement (ILR): It’s important to note that time spent on the Tier 1 Graduate Entrepreneur Visa does not count towards your qualifying period for Indefinite Leave to Remain (ILR, or settlement). However, you may be able to switch your visa to one that does allow you to eventually qualify for settlement.

Act Now: If your Tier 1 Graduate Entrepreneur Visa is nearing expiry and you haven’t yet explored extension options, it’s crucial to act quickly. Failure to extend your visa in a timely manner could lead to complications with your immigration status.

What Are My Options?

The UK Government replaced the Tier 1 Graduate Entrepreneur Visa with two new categories designed for entrepreneurs:

Start-Up Visa: This visa is intended for those starting a new business in the UK for the first time. It offers an initial two-year stay, with no significant investment funds required.

Innovator Visa: Geared towards more experienced entrepreneurs, this route requires a minimum investment of £50,000 in your business idea. It also offers a two-year initial stay, with a potential pathway to settlement after three years.

Switching Options

It may be possible to switch from your Tier 1 Graduate Entrepreneur Visa to either the Start-Up or Innovator Visa. The eligibility criteria and process can be complex, so it’s essential to seek professional guidance before initiating a switch.

Frequently Asked Questions

The changes to the Tier 1 Graduate Entrepreneur Visa likely raise many questions. Here are some of the most common concerns, along with general guidance. Remember, it’s always best to seek personalized advice from immigration professionals for your specific circumstances.

Can I bring my family with me if I switch to a Start-up Visa or Innovator Visa?

Yes, both the Start-Up and Innovator Visas allow you to bring dependents, including your partner and children. However, eligibility requirements and the application process for dependents can differ slightly from your own.

What happens if my business idea changes while on a Start-Up or Innovator Visa?

Both visas require you to work on the business plan approved by your endorsing body. Significant changes to your idea may require you to re-apply or discuss modifications with your endorsing body and the Home Office. It’s advisable to consult an immigration specialist if you foresee major business shifts.

I’m not sure if I’m eligible for either the Start-Up or Innovator Visa. What should I do?

Assessing your eligibility is an essential first step. Barar Associates offers eligibility assessments to help you understand your options and make informed decisions. These consultations go beyond basic online resources for a more in-depth analysis of your situation.

Can I switch to a different type of visa later on?

Potentially, yes. Depending on your business’s progress and personal circumstances, you might later become eligible for other UK visa categories. This is where the challenge of immigration law comes into play, and professional guidance is invaluable for future planning.

The process seems overwhelming. Where do I start?

The best way to start is by contacting the immigration specialists at Barar Associates. A consultation will help clarify your options and give you a roadmap for the next steps.
