Legislation Update: Statement of Changes to the Immigration Rules (HC 733)

The latest Statement of Changes has now been published, containing key changes across a wide range of different routes. The most notable amendments relate to minimum salary increases for Care Workers and Senior Care Workers and revisions for the new Electronic Travel Authorisation (“ETA”).

  1. Minimum Salary increase for Care Workers

The general minimum salary floor for Care Workers and Senior Care Workers is considerably lower than for other occupations for Skilled Workers with a gross annual salary of £23,200 (or £11.90 per hour) compared to £38,700. However, this set to increase to £25,000 per year (or £12.82 per hour). Additionally, the going rate for these Standard Occupation Classification (“SoC”) Codes will also be increasing, in line with national pay scales.

These changes will affect applications submitted on or after 9th April 2025 and relate only to care jobs in England (N Ireland, Scotland and Wales remain unaffected).

  1. ETA updates regarding Trinidad and Tobago nationals and BN(O) Passport Holders

An ETA gives certain foreign visitors permission to travel to or transit through the UK without having to apply for a Visitor visa or Direct Airside Transit visa.

Currently, citizens of Trinidad and Tobago are included within the scope of the ETA, however, recent statistics have shown that a majority of asylum claims from nationals of Trinidad and Tobago were made at port on arrival in the UK. Therefore, the Home Office has taken the decision to remove nationals of Trinidad and Tobago from the ETA Nationals List and introduce Visit visa requirements instead. In doing so, the Home Office hopes to reduce the number of asylum claims submitted as the intentions to visiting the UK can be assessed in far greater detail in accordance with the Visitor visa rules.

There will be a transition period during which these changes will take effect, for those who have a confirmed travel booking made prior to the introduction, from 12th March 2025 to 23rd April 2025 and they will be able to travel to the UK with an ETA during this time.

Applications for an ETA for nationals of Trinidad and Tobago however closed at 3pm on 12th March 2025 and Individuals who have confirmed bookings for travel to the UK on a date after the transition period ends will need to obtain a Visitor visa prior to travel.

Additionally, from 5th March 2025, the requirement for an ETA extended to British National (Overseas) passport holders, however they have now been made exempt from 13th March 2025.

  1. Changes to EUSS Family Permit sponsor criteria and other Settlement Scheme amendments

Applications for an EUSS family permit will no longer be accepted if the family member sponsor became an EU, EEA or Swiss citizen after the end of the transition period.

Furthermore, non-EEA national applicants are to be permitted to use a Biometric Residence Card (“BRC”) or Permit (“BRP”) which has expired by up to 18 months as proof of their identity and consequently will not be required to re-enrol their fingerprint biometrics, which will save time and minimise administrative hurdles.

  1. Other minor changes to note

There were other minor changes outlined in the recent Statement of Changes including the following:

Administrative Review Validity Requirements

Firstly, from 9th April 2025, the validity requirements for Administrative Reviews will be amended to ensure applicants who have permission to stay in the UK must remain in the UK in line with the rules for other statutory appeals.

Secondly, the validity requirements are also being updated to ensure that an applicant is considered for only one type of visa at a time, avoiding conflicts should both be granted.

Updates to the Global Talent and Global Talent Prestigious Prizes routes

At the request of Arts Council England and their sub-endorsing bodies, there have been amendments to some of the evidential requirements.

Additionally, applicants who are in receipt of a prestigious prize are not required to obtain an endorsement before applying for the Global Talent visa. As per the advice of the expert bodies, the prizes list must demonstrate irrefutable evidence of prize holders being at the pinnacle of their profession.

Annual update to the Permit Free Festival List

As of 12th March 2025, new festivals are added to the Permit Free Festival List for 2025, which allows international performers to showcase work and be paid for it, without needing sponsorship under one of the sponsored work routes.

New annual quotas for the Youth Mobility Scheme (“YMS”)

The YMS route is subject to annual quotas. This will be reset for 2025, from 9th April 2025.
