A Family Visa is an immigration route under which someone can live in the UK for more than 6 months with their family member who is already settled or having the right to live in the UK.
You can apply when you are:
Once you are on a qualifying family visa route, you may become eligible for Indefinite Leave to Remain (ILR) after the required period (typically 5 years for partner route) and eventually British citizenship.
To apply as a partner you must be 18 or over and your sponsor must usually be a British citizen, Irish citizen, or settled in the UK.
You must demonstrate:
Dependent children (under 18) may apply either with the parent or separately. They must live with the parent unless they are in full-time education away from home.
In certain limited cases (for example adults needing long-term care by a UK relative) you may apply for a family visa, though these routes tend to have higher evidential requirements.
For partner/spouse applications, the usual minimum income is £29,000 per year.
If you can’t meet this through income, you may still meet the requirement via savings, pensions or combination of sources.
You must satisfy the English language requirement (unless exempt) and show your relationship is genuine and lasting.
You must have adequate accommodation for you and any dependants without recourse to public funds.
For partner/spouse routes, you can typically apply for ILR after 5 years’ continuous residence on the visa. Switching rules and absences may affect this.
How long does it take to get a partner or spouse visa?
If applying from outside the UK, decisions are usually made within 3 weeks.
Can I bring my children with me on a family visa?
Yes — children under 18 may apply as your dependants. The financial, accommodation and relationship criteria will need to cover them as well.
Do I need to live together before applying for a partner visa?
You need to show your relationship is genuine, subsisting and you intend to live together. For unmarried partners you may need to show you have lived together for at least 2 years.
What if my sponsor earns less than £29,000?
There are alternative ways to meet the financial requirement (e.g., savings). A lawyer can assess whether you qualify under an exemption or alternative route.
