Private Life under paragraph 276ADE of the Immigration Rules.
Individuals who have spent most of their lives in the UK and have established private and family life in the UK may be eligible for leave to remain which eventually leads to qualifying for Indefinite Leave to Remain.
There are different categories under this route which are as follows:
- The applicant is under the age of 18 years and has lived continuously in the UK for at least 7 years and it would not be reasonably to expect the applicant to leave the UK; or
- The applicant(s) is a parent or parents of the applicant under section a), and they both established their private and family life in the UK;
- The applicant is aged 18 years or above and under 25 years and has spent at least half of his life living continuously in the UK;
- The applicant is aged 18 years or above, has lived continuously in the UK for less than 20 years but there would be very significant obstacles to the applicant’s integration into the country to which he would have to go if required to leave the UK
The applications for the above-mentioned categories are mainly based on Article 8 of European Convention Human Rights under the Human Rights Act 1998.
